These websites (“Terms“) are published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011. These Terms are an ‘electronic record’ as contemplated under section 2(t) of the Information Technology Act, 2000 and the Rules thereunder. These Terms being an electronic record are generated by a computer system and do not require any physical or digital signatures.

Eligibility

The user should have completed 18 years of age and be competent to enter into a contract under Indian contract law. Any user under 18 years of age who is intending to avail the services of the Website should do so through his or her legal guardian in accordance with applicable law.

Legal

These terms and conditions are subject to Indian laws and any dispute shall be subject to the jurisdiction of the courts in Coimbatore only.

Customer or Buyer

The person or any legal entity who accepts the offer for sale of goods/services by placing an order for and or purchases any deal/ Coupons offered for sale on affiliates.

Payment

A minimum deposit of the package cost will be required when the order for installation is placed via our website. The amount payable is displayed with each listing. The balance is payable immediately upon completion of the work by our service engineer on the day. Payment is by cash, bank transfer or debit/credit card. The following payment cards are accepted: Visa, MasterCard, Maestro, Delta, Electron or Solo & American Express. The payment is to be completed BEFORE the engineer leaves the property. WE DO NOT ACCEPT CHEQUES.

We expect you to pay monies due promptly. If payment to us is overdue, we will charge you interest at 2% over the base rate of National Westminster Bank, from the date of our invoice until the date you pay PLUS a late payment fee of Rs99.00 Should you refuse to pay the money plus any interest and late payment fee due to us, we will transfer the payment collection to a debt recovery agent or solicitor. The additional costs of the debt collection and any legal and court fees will also apply.

CCTV orders that are cancelled beyond the 14 day cooling off period and 24 hours prior to the agreed installation date will be subject to a Rs10 processing fee. The remainder of the deposit will then be returned to you in the form it was paid (Card, BACS, PayPal etc) If a CCTV Service plan is cancelled by the customer and a refund requested, a processing fee of Rs10 will be deducted from the balance which will be transferred back to the customer via BACS within five working days.

General issues

Use of the Website and any of Services is subject to these Terms & Conditions laid out. The Who Cares Magazine website and its Services are directed and intended for the sole use of customers in India, we do not undertake the responsibility for any consequences arising from the use of the Website or its Services from any locations outside India.

Who Cares Magazine Website and Service

We do no give the guarantee of uninterrupted use of the Website or its Services and access to the same may be suspended, restricted or terminated at any point in time. We reserve the right to change, modify or delete any information or any discount/ voucher code at any time without giving any prior notice

Property Rights

Guarantee/Warranty

We provide a warranty period of 36 months on all of our CCTV products. The first 12 months also include labour where applicable during the RMA process. The customer must notify us immediately via our support email of a fault occurring with the security system and we will repair such fault as soon as possible after receiving notification. We guarantee that we will repair hardware related faults in the installed system free of charge within the warranty period from the installation date. The guarantee does not apply if we believe or have reason to suspect that changes have been made to a system/products supplied by our company or to faults caused by the following:

A call out fee of at least Rs90+VAT will be charged if the fault / malfunction caused to the system has been made by the user and not a defective part / installation. For example, if an engineer attends to assess a ‘no video’ issue that has been caused by the customer accidentally or otherwise cutting, or disturbing the installation cables / components, a fee will be chargeable. If upon investigation there is a faulty part this will be repaired or replaced with no fee payable within the warranty period. If your system is older than 12 months, but less than 35 months – you are required to order a warranty callout package to cover the RMA procedure.

Remote viewing & it issues

If we are unable to configure the remote viewing on the day of the scheduled installation due to IT technical issues, ISP unavailability or lack of details such as Router IP address, user name and password then further charges will apply to remotely configure or revisit to complete the set up. The company (Who Cares Magazine ) cannot be held liable for client IT issues such as change of router, failed connection, change of internet service provider, re-set of router, new mobile phone, loss of settings on the router or a new operating system.

Termination of user accounts

Who Cares Magazine reserve the right to suspend your use of the Service or the Website, in whole or part, if you use the Who Cares Magazine services or the Website in violation of this Agreement. Who Cares Magazine also reserve the rights to terminate your use of the Service and Website or Service of anyone other than you, using the Website or Service with your permission in violation of this agreement if we believe that you have committed any breach of this agreement and on reasonable grounds, that you may commit a breach of these Terms and Conditions.

Equipment

If you would like to cancel an installation you’ve arranged online, over the phone, you are entitled to a 14-day cooling-off period during which you can cancel for any reason and get your money back. You also get this cooling-off period if you were approached by the business somewhere off the business’s premises and it costs Rs42 or more. Your cooling-off period begins the day after you enter into contract with the us – verbal or otherwise.

If a ‘permit to work‘ agreement has been signed by the customer, in order to allow us to commence work prior to the expiry of the 14 day cancellation period, you understand that if you subsequently cancel the contract within the 14 day period, you will be asked to pay for any work that has been carried out prior to the cancellation. To ensure consistency of installation, quality and service our engineers will perform pre and post installation checks on the equipment and will photograph completed installations. We will provide full training on completion of installation.

The company (Who Cares Magazine ) does not act and shall not be deemed to act as an insurer of the customers property or contents contained therein and give no warranty that by virtue of the installation of the system, the property or contents contained therein are completely secure or inviolable.

The company (Who Cares Magazine ) shall have no liability in contract, unless due to our own negligence for any loss suffered and in particular, we do not accept any liability whatsoever for any consequential loss or damage (including loss of earnings or profits) which may arise from any malfunction or defect of the system. The terms and conditions given in this contract do not affect your rights under the Sale of Goods Act or Unfair Contract Terms Act.
